Momonga Software Guideline

This document contains important information on distributing and licensing
issues of Momonga Linux. By using or redistributing Momonga Linux, you
agree to all of the following terms and conditions.
0. Definitions:
0-1: "Momonga Project" shall mean the Project that develops Linux Distribution
represented by momonga-linux.org.
0-2: "Momonga Linux" shall mean the Linux distribution officially released
by Momonga Project and/or the directory tree exhibited on Momonga
Project's website which is used for its development.
0-3: "Component" shall mean any and all software, code, fonts, and documents,
etc. that are part of Momonga Linux.
0-4: "Momonga Main" shall mean all components of Momonga Linux that meet
the terms and conditions of this Momonga Software Guideline. "Momonga
Main" includes all components of Momonga Linux that are not Momonga
Nonfree.
0-5: "Momonga Nonfree" shall mean all components of Momonga Linux that is
placed under the Nonfree directory. Momonga Project does not; guarantee
and/or govern any terms or conditions for redistributing components of
Momonga Nonfree.
0-6: "Redistribute" shall mean giving, releasing or lending any copy or copies
of licensed products whether for gratis or for a fee.
1. Copyright for editing:
Momonga Project holds the copyright for editing Momonga Linux.
2. Terms and Conditions of redistributing :
2-1: Momonga Main can be copied and/or redistributed whether for gratis or
for fee as long as its identity is maintained. "Maintaining identity"
means to maintain the directory tree structure or to duplicate the
Momonga Project distribution image file.
2-2: All rights shall not be restricted to recipients of the redistributed
Momonga Main. Each time you redistribute Momonga Main, the recipient
automatically receives a license from the original licensor to copy,
redistribute Momonga Main subject to all of these terms and conditions.
2-3: There shall be no restriction to personal or corporate use and/or
redistributing of Momonga Main regardless of the purpose of use and/or
redistributing.
3. Terms and Conditions of components:
3-1: Momonga Project shall not include components that have terms and
conditions on redistributing format (i.e.: "in executable format only")
and/or restrictions regarding distribution media/method in Momonga Main.
3-2: Momonga Project shall not include components that have restrictions on
redistributing components that are simultaneously redistributed with
Momonga Main and/or restrictions on redistributing format/method in
Momonga Main. This restriction applies to components regardless of
whether the components that are simultaneously redistributed with
Momonga Main are part of Momonga Linux or not.
4. Notice to Momonga Project on including components:
4-1: You (hereinafter referred to as "Momonga Project") may include components
that require special procedure in acquiring permission to redistribute it
in Momonga Main. However, if the procedure is similar to that of Momonga
Linux, the component must be able to accept same redistributing terms
and conditions as those of Momonga Linux.
4-2: It is preferable to have source codes for components of Momonga Linux.
Components that have restriction on redistributing its source code should
not be included in Momonga Main.
4-3: If the component of Momonga Main depends on other software, etc., when
executed, the depended software, etc., must be a component of Momonga
Main as well.
5. Terms and Conditions of modifying components and its coverage:
5-1: Components of Momonga Linux must be modifiable to be redistributed
as parts of Momonga Linux. The redistributed components must be
modifiable as well.
However, if some or all of the componenets are distributed as executable
binary code by the origianl distributor, the distributions of such
components are not restricted under the above term.
5-2: If you modify components of Momonga Linux, the modified parts are
subject to all of the terms and conditions of this Momonga Software
Guideline. Furthermore, redistributing the modified parts may not be
subject to additional restriction, other than the terms and conditions of
this Momonga Software Guideline.
5-3: You are not obliged to exhibit the modified components of Momonga Main on
Momonga Project's website. However, you cannot restrict anyone from doing
so.
5-4: Momonga Project specifically does not warrant, represent, or guarantee
whether it is permitted or not to modify the component of Momonga Main
other than redistributing as Momonga Linux. If you wish to redistribute
whatever you modify, it is your sole and exclusive responsibility to
confirm such and make necessary arrangements/agreements with its original
licenser.
6. Others:
6-1: Complete duplicates of Momonga Main can be considered as Momonga Linux.
6-2: All or part of Momonga Nonfree maybe included in the redistribution of
Momonga Linux. However, Momonga Project does not guarantee the
legitimacy of redistributing it.If you wish to redistribute it, it is
your sole and exclusive responsibility to confirm with its original
licenser on any terms and/or conditions.
6-3: Copyrights of components of Momonga Linux are the property of their
respective holder. If you wish to redistribute any of the components in
any other form than Momonga Linux, it is your sole and exclusive
responsibility to confirm with its original licenser on any terms and/or
conditions.
7. Limited Liability:
7.1: Under no circumstances shall Momonga Project be liable for the use
and/or redistribution of Momonga Linux, Momonga Main, and/or related
issues. Momonga Project shall not be liable or obligated with respect to
the subject matter of this document or under any contract, negligence,
strict liability or other legal or equitable theory: (i) for any amounts
in excess in the aggregate of the fees paid to it here-under with
respect to the applicable services; (ii) for any cost of procurement of
substitute goods, technology, services or rights; or (iii) for
interruption of use or loss or corruption of data, (iii) for any matter
beyond its reasonable control, or (iv) for any incidental, indirect or
consequential, punitive damages or lost profits.
8. Modifications and Governing Law:
8.1: Any and all changes and additions to this document must be agreed to in
writing by all affected parties.
8.2: The substantive laws of the State of California (and not the law
regarding conflicts of law) shall govern all of the issues herein.
